User Agreement

Section 1: General Provisions

1.1. Purpose and subject of the Agreement

1.1.1. This User Agreement (hereinafter — the "Agreement") defines the terms of use of the Coinmoneyhub (CMH) website and governs the relationship between the Service and any individual accessing the website and/or using its functionality (hereinafter — the "User").

1.1.2. The Agreement establishes the rights, obligations, and responsibilities of the Parties, as well as the general conditions for granting access to the functionality of the Service.

1.1.3. This Agreement does not regulate the detailed terms for conducting digital asset exchange operations. Such terms are defined in a separate document — the "Exchange Rules," published on the Service website and forming an integral part of the regulation of relations between the User and the Service.

1.2. Status of the Service

1.2.1. Coinmoneyhub (CMH) is an online service providing functionality for the exchange of digital assets in accordance with the terms established by the Exchange Rules.

1.2.2. The Service does not store User funds and does not provide services for opening or maintaining accounts or electronic wallets, unless explicitly provided by the website functionality and stated on the Service pages.

1.2.3. Use of the Service is carried out by the User independently, with an understanding of the specifics of digital asset operations and the terms established by the Exchange Rules.

1.3. Terms and definitions

For the purposes of this Agreement, the following main terms are used:

  • Service (CMH) — the Coinmoneyhub website and its functional modules providing the possibility of digital asset exchange.
  • User — an individual accessing the Service or using its functionality.
  • Exchange Rules — a separate document governing the procedure for executing and conducting digital asset exchange operations.
  • AML/KYC policies — internal rules of the Service regulating procedures for identification, verification, and monitoring of operations.

Other terms are interpreted according to the meaning established by the Exchange Rules or in their common usage.

1.4. Acceptance of the Agreement

1.4.1. Access to the Service, account registration, creation of requests, as well as any actual use of the Service functionality constitutes full and unconditional acceptance by the User of the terms of this Agreement.

1.4.2. Acceptance of the Agreement is deemed to occur from the moment of the User's use of the Service and does not require signing a separate document.

1.4.3. The User confirms that prior to using the Service, they have read the terms of this Agreement, the Exchange Rules, AML/KYC policies, and the Privacy Policy, understand their content, and accept them in full.

1.4.4. In case of disagreement with the terms of this Agreement, the User must cease using the Service.

1.5. Related documents

1.5.1. This Agreement applies in conjunction with:

  • Exchange Rules;
  • AML/KYC policies;
  • Privacy Policy;
  • Other documents published on the Service website.

1.5.2. In case of discrepancies between the provisions of this Agreement and the Exchange Rules, the priority in regulating digital asset exchange operations shall be given to the Exchange Rules.

1.5.3. All the documents listed in clause 1.5.1 are binding on the User from the moment of acceptance of this Agreement.

Section 2: Terms of Use of the Service

2.1. General requirements for using the Service

2.1.1. The User undertakes to use the Service exclusively for purposes provided by its functionality and in accordance with this Agreement, the Exchange Rules, and other documents posted on the website.

2.1.2. When using the Service, the User undertakes to act in good faith, not to perform actions that could disrupt the Service, affect its stability, security, or availability for other users.

2.1.3. The use of the Service through automated tools, software, scripts, or other instruments aimed at interfering with the operation of the Service or obtaining unlawful advantages is prohibited.

2.1.4. The User undertakes not to use the Service for purposes contrary to applicable AML/KYC policies and directives and the restrictions set out in the Exchange Rules.

2.2. Access to Service functionality

2.2.1. Access to specific functions of the Service may be provided after registration, identification, or fulfillment of other conditions established by the internal rules of the Service.

2.2.2. The Service may impose technical, quantitative, and other limitations on the use of functionality if necessary to ensure security, stability, or compliance with internal procedures.

2.2.3. The Service makes reasonable efforts to ensure uninterrupted operation but does not guarantee absolute continuity or absence of technical failures.

2.3. Age and other restrictions

2.3.1. The Service may only be used by individuals of legal age who possess full legal capacity.

2.3.2. The User confirms that using the Service does not contradict any restrictions or prohibitions applicable to them under the law of their place of residence.

2.3.3. The Service is not intended for use by individuals subject to restrictions established by the internal policies of the Service, including AML/KYC procedures.

2.4. Limitation and suspension of access

2.4.1. The Service may temporarily limit or completely suspend the User's access to functionality in case of violation of this Agreement, the Exchange Rules, or other Service documents.

2.4.2. Access may also be limited in the presence of signs of suspicious activity, the need for additional verification, or technical maintenance.

2.4.3. Access restrictions may be applied without prior notice when required to ensure the security of the Service or prevent potential violations.

2.4.4. Access is restored after the circumstances causing the restriction are resolved, in accordance with the internal procedures of the Service.

Section 3: Rights and Obligations of the User

3.1. Obligation to provide accurate information

3.1.1. The User undertakes to provide the Service with accurate, up-to-date, and complete information when registering, creating requests, undergoing identification, and using the Service functionality.

3.1.2. The User is responsible for the correctness and relevance of the provided information.

3.1.3. In case of any changes to the provided information, the User undertakes to promptly update the corresponding data.

3.2. Compliance with Exchange Rules and Service policies

3.2.1. The User undertakes to comply with the Exchange Rules, AML/KYC policies, Privacy Policy, and other documents posted on the Service website.

3.2.2. The User confirms that they have reviewed these documents and accept their terms in full.

3.2.3. Failure to comply with the Exchange Rules or internal Service policies may serve as a reason for restricting access to functionality in accordance with this Agreement.

3.3. Responsibility for account access security

3.3.1. The User undertakes to maintain the confidentiality of account access data, including login, password, confirmation codes, and other authentication means.

3.3.2. The User is responsible for all actions performed using their account.

3.3.3. In case of loss of access to the account or detection of unauthorized access, the User undertakes to immediately notify the Service.

3.4. Prohibition on third-party use of the Service

3.4.1. The User is not allowed to grant access to their account to third parties or allow the Service to be used on their behalf.

3.4.2. The Service may only be used by the individual who has completed registration and/or identification in accordance with the established procedure.

3.4.3. The User is responsible for the consequences of granting account access to third parties.

Section 4: Rights and Obligations of the Service

4.1. Right to verify and identify the User

4.1.1. The Service has the right to request information and documents from the User necessary for identification, identity verification, and confirmation of the source of funds within the framework of internal procedures and AML/KYC policies.

4.1.2. The Service has the right to conduct additional checks on transactions if signs of increased risk or non-compliance with established requirements are detected.

4.1.3. Failure of the User to provide the requested information may serve as a reason for restricting access to the Service functionality in accordance with this Agreement and the Exchange Rules.

4.2. Right to limit or refuse service

4.2.1. The Service has the right to temporarily restrict the User's access to functionality or refuse to process a transaction in case of violation of this Agreement, the Exchange Rules, or internal Service policies.

4.2.2. Access restrictions may also be applied if signs of suspicious activity are detected, additional verification is required, or for ensuring the security of the Service.

4.2.3. The Service has the right to refuse service without explanation in cases where it is required to comply with internal security procedures and risk management policies.

4.3. Ensuring technical operation of the Service

4.3.1. The Service makes reasonable efforts to ensure stable and correct operation of the website and its functionality.

4.3.2. The Service may perform technical maintenance, updates, or software upgrades, which may temporarily affect the availability of certain functions.

4.3.3. The Service does not guarantee complete absence of technical failures, delays, or interruptions caused by the specifics of data transmission networks and blockchain networks.

4.4. Changes to functionality

4.4.1. The Service has the right to modify, supplement, or limit the website functionality without prior agreement with the User.

4.4.2. Functionality updates may include changes to the interface, technical performance parameters, available exchange directions, and other Service characteristics.

4.4.3. Use of the Service after changes have been made constitutes the User's acceptance of the updated functionality.

Section 5: Data Processing and Confidentiality

5.1. General provisions on data processing

5.1.1. In the course of using the Service, the User provides or undertakes to provide, upon additional request, data necessary for registration, submitting requests, completing identification, and interacting with the Service.

5.1.2. Data processing is carried out by the Service for the purpose of ensuring the website's functionality, performing digital asset exchange operations, and complying with internal security procedures and AML/KYC policies.

5.1.3. Data processing includes the collection, systematization, storage, use, and other actions necessary to properly provide the Service functionality.

5.2. User consent to data processing

5.2.1. By confirming this Agreement, the User consents to the processing of the data provided by them in the scope and for the purposes specified in this section and in the Privacy Policy.

5.2.2. The User confirms that the provided data is accurate and submitted voluntarily.

5.2.3. If the User refuses to provide the necessary data, the Service may restrict access to certain features if their use is impossible without the required information, or may refuse further service and suspend the processing of the transaction.

5.3. Privacy Policy

5.3.1. Detailed conditions for the processing, storage, and protection of data are defined in the Privacy Policy, which is published on the Service website.

5.3.2. The Privacy Policy is an integral part of the regulation of relations between the User and the Service.

5.3.3. Use of the Service signifies the User's agreement with the terms of the Privacy Policy.

Section 6: Limitation of Liability

6.1. General principles of liability limitation

6.1.1. The Service provides access to the website functionality and processes requests in accordance with this Agreement and the Exchange Rules, making reasonable efforts to ensure the correctness and stability of operations.

6.1.2. The User understands and accepts that digital asset transactions are associated with technological, network, and market characteristics that are not fully under the Service's control, may have dependencies affecting the Service itself, and depend on external factors that are not fully or at all controlled by the Service.

6.1.3. The Service is not responsible for the consequences of decisions made by the User while using the website functionality, including decisions regarding digital asset transactions.

6.1.4. The Service's liability, in any case, is limited to the scope of the service actually rendered within the framework of a specific operation, unless otherwise expressly provided by this Agreement.

6.2. Liability for User actions

6.2.1. The User is solely responsible for the accuracy of the information provided, including account details, digital asset addresses, payment information, and other data necessary for conducting operations.

6.2.2. The Service is not liable for the consequences of errors made by the User when entering data, selecting the exchange direction, or specifying technical parameters of an operation.

6.2.3. The User is responsible for compliance with requirements and restrictions applicable to them personally in connection with the use of digital assets.

6.2.4. In the event of granting access to their account to third parties, the User assumes full responsibility for the consequences of such actions.

6.3. Limitations related to external systems and networks

6.3.1. The Service is not responsible for delays, technical failures, or errors caused by external payment systems, banks, blockchain networks, communication providers, or other third parties.

6.3.2. The Service is not responsible for the confirmation speed of transactions in blockchain networks, the correctness of network nodes, changes in network fees, or other technical parameters determined by the specifics of a given digital network.

6.3.3. The Service is not responsible for the inability to conduct an operation due to technical limitations, updates, or changes in third-party infrastructure.

6.3.4. The User acknowledges and agrees that digital assets operate in distributed networks, the characteristics of which may change without the involvement of the Service.

6.4. Force majeure circumstances

6.4.1. The Service is not responsible for partial or complete failure to perform obligations if such failure is caused by circumstances beyond the reasonable control of the Service.

6.4.2. Such circumstances may include technical accidents, communication network outages, actions of third parties, cyberattacks, software failures, restricted access to infrastructure, and other events that could not have been foreseen or prevented by reasonable measures.

6.4.3. In the event of such circumstances, the Service undertakes reasonable, emergency, and timely measures to restore normal operation as quickly as possible.

Section 7: Intellectual Property

7.1. Exclusive rights to Service materials

7.1.1. All elements of the website, including source code, design, interface structure, graphic elements, logos, texts, databases, images, and other materials and results of intellectual activity published on the website, are the property of the Service or are used on lawful grounds.

7.1.2. Use of website materials is allowed solely within the functionality provided to the User under this Agreement.

7.1.3. Nothing in this Agreement may be interpreted as transferring any exclusive rights to intellectual property objects to the User.

7.2. Usage restrictions

7.2.1. Without prior written consent from the Service, the User is prohibited from:

  • copying, reproducing, distributing, or otherwise using website materials in full or in part;
  • modifying, adapting, decompiling, disassembling, or otherwise examining the website's source code;
  • using design elements, trade names, logos, or other Service identifiers for commercial or public purposes;
  • creating derivative products or services based on the website's functionality.

7.2.2. Use of the website is allowed solely for personal purposes within the provided functionality.

7.3. Rights infringement

7.3.1. In case of unauthorized use of intellectual property objects, the Service has the right to apply measures to protect its rights, including limiting access to website functionality.

7.3.2. The User agrees to refrain from any actions that may violate the Service's rights or create a risk of such violations.

Section 8: Amendment of the Agreement

8.1. Service's right to modify terms

8.1.1. The Service reserves the right at any time to make changes, clarifications, or additions to the terms of this Agreement for the purpose of improving functionality, ensuring security, and complying with internal policies and technological requirements.

8.1.2. Changes may concern the use of the website, registration and identification of Users, data processing, limitation of liability, provision of functionality, and other provisions affecting the relationship between the Service and the User.

8.1.3. The Service makes changes taking into account the interests of Users and aiming to minimize risks, ensure uninterrupted operation, and maintain proper functioning of the Service.

8.1.4. The introduction of changes does not affect the legality of previously executed operations unless explicitly stated otherwise in the new version of the Agreement.

8.2. Procedure for entry into force of changes

8.2.1. New or amended terms of the Agreement take effect from the moment of their publication on the Service's website, unless a different date is specified in the notification of changes.

8.2.2. The Service may notify Users of changes via email, internal notifications, or publication on the website.

8.2.3. Continued use of the Service after publication of changes is considered confirmation of the User's acceptance of the updated terms.

8.2.4. If the User does not agree with the changes, they must stop using the Service and refrain from further operations until any disagreement is resolved.

8.2.5. When updating the terms of the Agreement, the Service may, if necessary, update references to related documents, such as the Exchange Rules, AML/KYC policies, and Privacy Policy, in accordance with the new provisions.

Section 9: Final Provisions

9.1. Priority of documents

9.1.1. This Agreement operates in conjunction with other Service documents, including the Exchange Rules, AML/KYC policies, and the Privacy Policy.

9.1.2. In case of conflicts between the provisions of this Agreement and specialized documents regulating specific aspects of the Service (for example, the Exchange Rules for digital asset transactions), the provisions of those documents shall take precedence to the extent they apply.

9.1.3. All documents listed in clause 9.1.1 are binding for the User from the moment of acceptance of this Agreement.

9.2. Invalidity of individual provisions

9.2.1. If any provision of this Agreement is recognized as invalid, unlawful, or unenforceable under applicable law, it does not affect the validity of the remaining provisions.

9.2.2. In the event an individual provision is deemed invalid, the Service reserves the right to replace it with a provision as close as possible in meaning and legal effect to the original.

9.2.3. The invalidity of individual provisions does not release the User from fulfilling the remaining obligations under this Agreement and related documents.

9.3. Contact information

9.3.1. To contact the Service, obtain consultations, or submit inquiries and requests, the User may use the contact details provided on the Service's website in the "Contacts" section.

9.3.2. The Service strives to ensure timely processing of inquiries and to inform the User of results within a reasonable timeframe.

9.3.3. The User undertakes to use the contact information solely for lawful purposes related to the use of the Service and not to send messages containing spam, threats, or illegal content.
